The Beaver Lake Cree Nation Custom Citizenship Code Committee has issued an important notice to BLCN members regarding the process of exploring and developing a Custom Citizenship Code under section 10 of the Indian Act.
BLCN is currently governed under section 11, meaning Indigenous Services Canada maintains the BLCN Band List and determines membership according to the Indian Act. Moving to section 10 would allow BLCN to maintain its own Band List and make citizenship decisions under a code developed for the Nation.
This process does not mean BLCN has already become a section 10 First Nation. A proposed Custom Citizenship Code cannot take effect without the required approval of eligible BLCN electors through a ratification vote.
The process will include research, drafting, community engagement, revisions, legal review, formal notice and a ratification vote. Members will have opportunities to review the proposed code, ask questions and provide recommendations before a final decision is made.
Taking control of citizenship is separate from registration for Indian status. The Government of Canada would continue to determine entitlement to Indian status and maintain the Indian Register.
